Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Dwelyx platform ("Service") operated as a sole trader trading as Dwelyx ("Dwelyx", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Dwelyx is a property management and compliance platform for UK residential landlords. The Service includes compliance tracking, finance tools, document storage, and related features as described on the pricing page. Features available to you depend on your subscription tier.

3. Eligibility

You must be at least 18 years old and a UK-based residential landlord (or authorised agent) to use Dwelyx. By registering, you confirm that the information you provide is accurate.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@dwelyx.co.uk if you suspect unauthorised access.

5. Subscriptions and Payment

  • Paid subscriptions are billed monthly in advance via Stripe.
  • All prices are in GBP. We are not VAT registered; no VAT is added to your subscription.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You may cancel at any time via the billing portal; access continues until the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
  • No refunds are issued for partial subscription periods unless required by law.

6. Free Plan and Trial

The free plan is provided without charge subject to usage limits stated on the pricing page. We may modify or discontinue the free plan at any time with reasonable notice. Trial periods, where offered, revert to the applicable paid plan or free plan at expiry.

7. Acceptable Use

You must not:

  • Use the Service for any unlawful purpose or in violation of any UK law.
  • Upload malicious files, viruses, or content that infringes third-party intellectual property rights.
  • Attempt to gain unauthorised access to other users' data or our systems.
  • Resell, sublicense, or commercially exploit the Service without our written consent.
  • Use the Service to store data unrelated to your property management activities.

8. Your Data

You retain ownership of all data you enter into Dwelyx. By uploading data, you grant us a limited licence to process and store it solely for the purpose of providing the Service. We do not claim ownership of your property, tenant, financial, or document data.

You are responsible for the accuracy of data you enter, including compliance deadlines, financial records, and tenant information. Dwelyx is a management tool and does not constitute legal or financial advice.

9. Compliance Information

Dwelyx provides compliance date tracking and reminders as a convenience tool. It is your sole responsibility as a landlord to ensure you meet all legal obligations under the Gas Safety (Installation and Use) Regulations, the Housing Act, the Renters' Rights Act 2025, and all other applicable UK legislation. Dwelyx accepts no liability for any regulatory breach, fine, or legal proceeding arising from your use of or reliance on the Service.

10. Intellectual Property

The Dwelyx platform, branding, and underlying software are the intellectual property of the operator of Dwelyx. You receive a limited, non-exclusive, non-transferable licence to use the Service for your personal property management purposes only.

11. Availability and Changes

We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. In the event of discontinuation of the entire Service, we will provide at least 30 days' notice and facilitate data export.

12. Limitation of Liability

To the maximum extent permitted by law, Dwelyx shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business arising out of your use of the Service. Our aggregate liability to you shall not exceed the total fees paid by you in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by English law.

13. Termination

You may close your account at any time via Settings. We may terminate or suspend your account immediately if you breach these Terms. On termination, your data will be retained for 30 days before deletion, during which you may request an export.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
